0 Ilham-Aziz reject S. Sulawesi poll results, aim to file lawsuit

A pair of candidates in the recent South Sulawesi gubernatorial election, Ilham Arief Sirajuddin and his running mate Abdul Aziz Qahhar Mudzakkar, said on Saturday they rejected the election results and would be filing a case with the Constitutional Court. Ilham said the decision to go to court was taken after his team of lawyers studied evidence of violations committed during the South Sulawesi gubernatorial election for the 2013-2018 period. The lawsuit would be filed with the Constitutional Court on Monday or Tuesday, he added. 

The South Sulawesi General Elections Commission (KPUD) announced on Thursday that incumbent Governor Syahrul Yasin Limpo and his running mate, Agus Arifin Nu’mang, had won the most votes. The incumbents garnered some 2.25 million votes, equalling 52.42 percent. Ilham and Azis received 1.78 million votes (41.57 percent), while Andi Rudiyanto Asapa and Andi Nawir Pasinringi only managed to get 257,973 votes (6.01 percent). Ilham, who is also mayor of the provincial capital, Makassar, said his legal team found a number of violations of election regulations and principles governing free and fair elections. 

He added that the violations led to the results of each pair. “We appreciate the KPUD’s approval but we cannot accept the results,” he said. “That is why we are going to file a lawsuit with the Constitutional Court.” Ilham’s supporters went berserk on Thursday protesting the KPUD announcement by setting alight a parked motorcycle and two cars that bore pictures of Syahrul and Agus, and pelting houses and stores with stones. He said his campaign team had found numerous examples of violations that substantially eroded the democratic process during the gubernatorial election on Jan. 22. 

He added that those examples and supporting evidence would be submitted to the Constitutional Court along with the lawsuit. Ilham declined to reveal details of the alleged violations his team had found. “I cannot say what the violations are but I will submit [my team’s] findings and evidence to the Constitutional Court when we file the lawsuit,” he said. A member of Ilham’s legal team, Deden Supriadi, said that the findings met the requirements set by the Constitutional Court to allow for the submission of such a lawsuit, and that they were structured, systematic and massive. 

“We have strong evidence,” said Deden, who is also an executive of the Democratic Party’s central executive committee, which handles general and regional elections. Ilham, chairman of the Democratic Party’s South Sulawesi chapter, maintained that it did not matter who won the gubernatorial election as long as victory was achieved in accordance with democratic principles. He added that any violations proved should be rectified so that the public would improve their knowledge of true democracy.
